I want to thank all of our speakers today and all of the attendees—the great thought leaders here in the intellectual property rights field.
我要感謝今天我們所有發(fā)言者和所有與會者——他們是這里知識產(chǎn)權(quán)領(lǐng)域的偉大思想領(lǐng)袖。

Today we have a great opportunity to hear from U.S. and Chinese leaders in the Intellectual Property Rights field.
今天,我們有很好的機(jī)會來聆聽美中知識產(chǎn)權(quán)領(lǐng)域領(lǐng)導(dǎo)人的發(fā)言。

I am especially pleased that Chairman Liu of the Education, Science, Culture, and Public Health Committee of the National People’s Congress, has been able to take time out of his busy schedule to speak with us today – so thank you Chairman Liu. Not just for speaking with us today, but for your incredible leadership on IPR protection and enforcement all these years. Let’s give Chairman Liu a big round of applause.

I also want to thank several Chinese government officials for attending this luncheon and also for participating in our forum this afternoon. We have Deputy Director General Chai of the Office of IPR Leading Group, Ministry of Commerce; Director General Yu of the National Copyright Administration of China; and Deputy Director General Yang of the Office of Treaty and Law of the Ministry of Commerce.

We established the Ambassador’s Intellectual Property Roundtable 11 years ago. It has since become a cornerstone for U.S.-China dialogue on intellectual property rights protection and enforcement.
11年前,我們成立了大使知識財產(chǎn)圓桌會議。從此,它已成為美中知識產(chǎn)權(quán)保護(hù)和強(qiáng)制執(zhí)行對話的基石。

The Roundtable has grown to include direct conversations between Chinese and American thought leaders, innovators on how China and the United States can work together to further enhance China’s Intellectual Property Rights systems for the benefit of innovators and consumers, not just in China, but around the world.
圓桌會議已經(jīng)成長為包括中美思想領(lǐng)袖、創(chuàng)新者的直接對話,該對話探討中國和美國如何能一起努力,進(jìn)一步加強(qiáng)中國的知識產(chǎn)權(quán)體系,造福于不只中國乃至世界各地的創(chuàng)新者和消費(fèi)者。

The great thing about this annual Roundtable is that the direct conversations we start here today will continue into the future.
這次年度圓桌會議的好處就是我們今天在這里開始的直接對話將延續(xù)下去。

Though we have many differences, our willingness to come together to resolve those differences means that we can find solutions that work for both sides.
雖然我們有很多分歧,但我們愿聚到一起解決這些分歧的意愿意味著我們能夠找到雙方都能接受解決辦法。

A truly innovation-based economy requires protection of intellectual property rights through effective and vigorous enforcement mechanisms, because for a right to be truly a right, for a right to be truly an asset—it can only happen if that right can be protected and the rights holder has confidence in the ability to enforce it.
一個真正的以創(chuàng)新為基礎(chǔ)的經(jīng)濟(jì)體需要通過有效且有力的強(qiáng)制執(zhí)行機(jī)制來保護(hù)知識產(chǎn)權(quán),因為要權(quán)利成為真正的權(quán)利,要權(quán)利成為真正的資產(chǎn) — 只有在權(quán)利能夠得到保護(hù),權(quán)利人對強(qiáng)制執(zhí)行它的能力有信心情況下,這才能發(fā)生。

And this confidence can only be gained by ensuring strong commercial rule of law.

I’m a lawyer by training, actually a former criminal prosecutor. But I’ve also been a governor of the state of Washington, Secretary of Commerce, and now U.S. Ambassador to China. And all throughout those posts, the importance of commercial rule of law has become even more clear, every single day.
我是一名受過訓(xùn)練的律師,一名前刑事公訴官。但我也曾是華盛頓州州長,商務(wù)部長,而現(xiàn)在是美國駐中國大使。在這些職位上時,每一天商業(yè)法治的重要性都變得更加明確。

There must be an appropriate and transparent legal regime. Companies must have access to complete and clear laws and rules that govern them.
必須有一套合適的、透明的法律體系。公司必須有機(jī)會了解管理他們的完整明晰的法律和規(guī)則。

Those laws and rules must be fair and balanced, and provide a legal framework that companies can understand and apply.
這些法律和規(guī)則必須是公平的、平衡的,并且提供一個公司能夠理解和應(yīng)用法律框架。

Commercial rule of law is not a single concept; instead it encompasses numerous components that must function together.
商業(yè)法治不是一個單一概念,相反它包含無數(shù)必須共同作用的組成部分。

Civil and criminal enforcement mechanisms must guarantee transparency before, during and after a trial.
民事和刑事強(qiáng)制執(zhí)行機(jī)制必須確保庭審之前,期間和之后的透明度。

All litigants must be permitted to participate equally and to support their side of the argument without overly burdensome procedural rules. And there must be consistency in application of procedural remedies, especially pre-trial remedies. And trial outcomes must compensate right holders fairly and deter future infringers.
所有訴訟當(dāng)事人都必須得到允許來平等地參與并支持自己一方的論點,不受過度繁瑣的程序規(guī)則限制。程序性補(bǔ)救措施的適用必須有一致性,特別是庭審前補(bǔ)救措施。庭審結(jié)果必須公平地補(bǔ)償權(quán)利人并遏制未來的侵權(quán)者。
